Why this privacy policy?

Pitts attaches great importance to the protection of your privacy and personal data. We use your personal data only in accordance with the applicable privacy legislation and other relevant legal provisions. Any reference in this Privacy Policy to the “Privacy Act” refers to the Belgian Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data. Any reference to the “Regulation” refers to the Regulation of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

With this Privacy Policy, Pitts informs you about the processing operations we may perform on your data and about your rights. By using our platform/website/application, you explicitly consent to possible processing operations by Pitts.

For what purposes are my personal data used?

What are my rights?

Guarantee of lawful and secure processing

Pitts always processes your personal data fairly and lawfully. This includes the following guarantees:

  • Personal data are processed only in accordance with the purposes described and justified in this Privacy Policy.
  • Personal data are processed only to the extent that they are adequate, relevant, and not excessive.
  • Personal data are retained only as long as necessary to achieve the purposes described and justified in this Privacy Policy.

The necessary technical and security measures have been taken to minimize the risks of unlawful access to or processing of personal data. In the event of an intrusion into its IT systems, Pitts will immediately take all possible measures to minimize the damage.

Right of access/rectification/erasure

Upon proof of your identity as a User, you have the right to obtain confirmation from Pitts as to whether your personal data are being processed. Where Pitts processes your data, you also have the right to access the collected personal data. If you wish to exercise your right of access, Pitts will comply within one (1) month of receiving the request. Requests can be made by registered mail or by sending an email to info@pitts.be.

Inaccurate or incomplete personal data can always be corrected. It is primarily up to the User to correct inaccuracies and incompleteness. You can exercise your right to rectification by providing an additional statement to Pitts. Pitts will comply within one (1) month of receiving the additional statement.

You also have the right to have your personal data erased without undue delay. You can rely on this right to be forgotten in the following cases:

  • When the personal data are no longer necessary for the purposes for which they were originally collected;
  • When the personal data were collected based on consent and no other legal basis for processing exists;
  • When you object to the processing and no overriding legitimate grounds for the processing exist;
  • When the personal data have been unlawfully processed;
  • When the personal data must be erased to comply with a legal obligation.

Pitts will assess whether one of the aforementioned cases applies.

Right to restriction/object to processing

You have the right to obtain restriction of processing of your personal data:

  • For the period Pitts needs to verify the accuracy of the personal data, in case of dispute;
  • When the processing is unlawful and you request the restriction of use instead of erasure;
  • When Pitts no longer needs your personal data for the purposes of processing, and you need the data for a legal claim;
  • For the period Pitts needs to assess the grounds for erasure of personal data.

You also have the right to object at any time to the processing of your personal data. Pitts will then cease processing your personal data unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms.

Right to data portability

You have the right to receive the personal data which you have provided to Pitts in a structured, commonly used, and machine-readable format, and to transmit those data to another controller when the processing is based solely on your consent.

If you wish to exercise this right, Pitts will comply within one (1) month of receiving the request. Requests can be made by registered mail or by sending an email to info@pitts.be.

Right to withdraw consent / right to lodge a complaint

You have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. In addition, you have the right to lodge a complaint concerning the processing of your personal data by Pitts with the Belgian Data Protection Authority.
