It is strictly forbidden to offer live animals, including pigeons, under the classifieds section. These advertisements will not be accepted. If you wish to sell pigeons, please contact the editorial team at info@Pitts.be. Pitts is not responsible for the goods offered for sale.
7. Sale of pigeons
Pitts is also known for its pigeon auctions all over the world. You can bid by simply placing a bid per pigeon or by registering as a potential buyer, which makes bidding easier. This may result in a purchase agreement. The following conditions apply.
-
Auctions
- Pitts sells pigeons that are offered by third parties (i.e. pigeon fanciers or consignors). The sale within an auction always proceeds via a bid. The bid that the potential buyer places is always binding. Pitts reserves the right to refuse this bid without providing further explanation. The bid is only final when Pitts has sent a confirmation email within 24 hours.
- The information provided for the auctions, both about the loft, the pigeon fancier and the pigeons sold, is supplied by third parties (i.e. pigeon fanciers who offer the pigeons to Pitts). Pitts cannot be held liable for the accuracy of this information provided by third parties.
- The consignors of the pigeons must deliver them to Pitts in good condition. The pigeons must also be vaccinated against paramyxo. For this, the consignor must present a veterinary certificate that is no more than 12 months old. The consignor will also provide a health certificate indicating the examinations and any relevant treatments of the last 3 months. This health certificate is supplied with every pigeon sold.
- If pigeons that have been sold prove to be infertile or less fertile, Pitts cannot be held liable. However, Pitts undertakes to play a mediating role between consignor and buyer, without any guarantee of an outcome.
- The buyer must always pay the amount before delivery to Pitts and this in euros. The amount shown on the site will be increased by 6% VAT according to Belgian tax law. The delivery address is Obbeekstraat 78 in Heusden‑Zolder, unless otherwise stated in the sale. Costs for home delivery, shipping abroad, various taxes such as import duties, are borne by the buyer. Pitts can help arrange these transactions. Costs will always be charged to the buyer.
- The pigeons will not be delivered before the full purchase amount has been paid to Pitts. The buyer has a maximum of 30 days for this. If payment has not been made or is insufficient within this period, the purchase agreement is automatically dissolved, but Pitts may still claim the additional administrative costs of 10% of the purchased pigeon with a minimum of 50 euros from the buyer. Buyers who do not pay will be blacklisted and automatically excluded from further participation in auctions.
- If the buyer desires a delivery address other than the delivery address at Obbeekstraat 78 in Heusden‑Zolder, Pitts is not responsible for the transport to the buyer, both domestically and abroad. Pitts is also not responsible for other problems during delivery, such as quarantine, import problems, etc.
- If the pigeon is ill upon delivery or in the event of death, the buyer has 48 hours to report this to the administrative seat of Pitts via email info@Pitts.be. Pitts reserves the right to appoint a veterinarian to examine the pigeon or to perform a post‑mortem if applicable. This will always be done in the event of death. The costs are borne by the buyer unless the complaint is justified; in that case, Pitts will bear the costs.
- Pitts is not responsible in cases of force majeure of any kind and is therefore not liable to pay damages to the buyer.
-
Pigeons at fixed price
- On Pitts, you can buy and offer pigeons at a fixed price. The consignors, i.e. the sellers, can submit their pigeons for sale by sending the pedigree, price and info to info@Pitts.be. Pitts will then make a selection and publish the pigeons with a photo on the site. The cost of the photo is borne by the seller. After the final selection, the seller sends the original pedigree and proof of ownership to Pitts.be. Upon final payment (the buyer sends proof of payment to Pitts) and completion of the sale, Pitts will send the pedigree to the buyer. The seller undertakes to offer the pigeons on Pitts for at least 12 months or until they are sold. He pays for the publicity once, regardless of whether a sale occurs. You can obtain the exact rates via Pitts. After those 12 months, the seller can decide whether the pigeon will still be published on Pitts (at no extra cost) or whether the publicity stops. Pitts is not the seller of the pigeons in this case but only advertises these pigeons on the site. The pigeons remain at the seller's loft until the sale. Pitts cannot be held liable for health, fertility or any other defect. These are the seller's responsibility. The delivery address is that of the seller, unless otherwise stated.
- The buyer can purchase the offered pigeon by sending an email to info@Pitts.be. The transaction is handled via email; this email is binding for the buyer. Pitts reserves the right to refuse a potential buyer without having to justify this. After payment of the purchase amount, Pitts will send the proof of ownership and the pedigree to the buyer. Delivery of the pigeon takes place at the seller’s home. Delivery to the buyer’s address is possible upon payment of additional transport costs.
8. Voucher auctions
For many years, clubs have been able to rely on Pitts to give extra visibility to their voucher auctions. Voucher auctions are, in a manner of speaking, donations of pigeons or eggs from strong performing fanciers to pigeon clubs. The proceeds from these "voucher auctions" allow the club to supplement the club treasury and to organize extras for the pigeon fanciers. Through Pitts, clubs can put their vouchers in the spotlight by organizing pre‑bidding on Pitts. ClubsResource can choose whether the bids are also the final bids or whether there is a subsequent “after” bidding at the pigeon club. This information is always clearly stated for each voucher sale. The buyer of these vouchers is also bound by the bid placed via Pitts. The buyer will be contacted by the club regarding payment and collection of the voucher. Pitts can in no way be held liable for the quality, collection, delivery or payment of these vouchers via voucher auctions. ClubsResource can obtain further terms via info@Pitts.be.
9. Law
This sales agreement and all other agreements with Pitts BVBA are subject to Belgian law, under the jurisdiction of the courts competent for Pitts BVBA. If any part of this agreement or the general terms is not enforceable or is annulled, the remainder of the agreement or the general terms will not lapse in its entirety.
